OSHA Amendments in Malaysia – Does it matter to you?

The latest OSHA amendments came into force on 1 June 2024. We are under the impression that the department of health and safety have been actively conducting compliance checks on employers, regardless of size of business.  


While many may assume that the OSHA will only apply to larger organisations, factories, or high-risk industries, you may be surprised to find out that the latest version of OSHA prescribes otherwise.  

Over the past month, we’ve conducted several compliance exercises and we’ve learnt a fair bit. Most of our exercises revolve around service providers with a range of 50 – 200 employees. Regardless of your team size, we encourage you to pay attention to the following areas if you’re considering an upgrade on your current policies:  

  

  1. Reviewing health and safety policies 

  2. Appoint, brief / train, safety coordinators 

  3. Form your internal safety committee based on DOSH requirements 

  4. Conduct risk assessments  

  5. Include psychosocial aspects 

  6. Conduct DASS assessments 

  7. Prepare communications on safety for all employees, new joiners, visitors, vendors, etc.  

  8. Set quarterly meetings on health and safety 

  9. Compile documentations related to meetings, briefings, trainings and any other efforts related to health and safety 

  

Now, to answer the question above. Yes, complying with OSHA matters! Think about it, would you want to be in a position where you’re receiving impromptu visits, going through investigations on a business day when you should be busy delivering outputs?  


We’d like to share a success story from a recent exercise.  


Our client, a global company having a presence of 30-40 employees in Malaysia reached out in their efforts to localize their global policy. This process required our consultants to look into the finer details of the amended version of OSHA. In the course of so doing, we ran through the 9 points mentioned above. The client was later visited by DOSH and they were cleared of any areas of non-compliance. Made our day!
